Privacy Policy

 

1. INDEMNITY/HOLD HARMLESS- Customers will take all necessary precautions regarding the items rented, and protect all persons and property from injury or damage. The customer agrees to hold Galaxy Party Rentals harmless from and against all liability, claims judgements, attorneys' fees and costs of every kind and nature, including, but not limited to, injury or death to persons and damage to property, arising out of the use, maintenance, instruction, operation, possession, ownership or rental of the items rented.
2. ASSUMPTION OF RISK/RELEASE-DISCHARGE OF LIABILITY- Customer is fully aware and acknowledges there is a risk of injury or damage arising out of the use or operation of the items rented and hereby elects to voluntarily enter into this rental agreement and assume all of the above risks of injury or damage. Customer agrees to release Galaxy Party Rentals from any and all responsibility or liability from such injury or damage arising out of the use or operation of the rental items. The customer further agrees to waive, release and discharge Galaxy Party Rentals of any and all claims for injury or damage which customer otherwise may be entitled to assert.
3. RECEIPT AND INSPECTION OF RENTAL ITEMS- The customer hires the rental items on an as is basis. Customer acknowledges that he/she has, or will personally inspect the rental items and find it suitable for the customer's needs before its use.
4. RENTAL POSSESSION- The customer's right to the possession of the rental items begins upon the items leaving Galaxy Party Rentals' center of distribution and terminates upon the agreed return date indicated in the rental agreement in the front of this page. During the customer's possession of the rental items, he/she defends and holds Galaxy Party Rentals unaccountable for any and all injury and death to persons and damage to property. Rental items must be returned upon the agreed return date to avoid any penalties. If items not returned on the proper date, the customer is subject to a 35% late fee charge per overdue day based on "TOTAL" indicated in the rental agreement.
5. DAMAGED AND LOST ITEMS- The customer shall be responsible for the cost of repairing or replacing any and all damages to rental items not caused by normal wear and tear. "Normal wear and tear" shall mean only the normal deterioration of the rental items caused by normal, responsible and proper use. Damage not considered as "normal wear and tear" includes, but is not limited to, damages due to overturning, overloading or exceeding rate capacities, breakage, improper use, abuse, lack of cleaning and negligence.
6. COMPLIANCE WITH LAWS DURING USE OF RENTAL ITEMS- The customer agrees not to use or allow anyone to use the rental items for any illegal purposes or any illegal or unsafe manner. The customer agrees, at his/her cost and expense, to comply with all municipal, county, state and federal laws, ordinances and regulations which may apply to the rental items during its rental period. The customer further agrees to pay all licenses, fines, fees, permits, or taxes arising from his/her use of the rental items. The customer is responsible for obtaining all proper permits and/or licenses from the appropriate government agencies. At the customer's request, Galaxy Party Rentals may act as an agent to obtain the proper permits and/or licensed from the appropriate government agencies. If these agencies should require additional rental items, the customer will be the sole responsible for the expenses. If permits and/or licenses are denied for any reason, the customer is still responsible for all financial and other obligations pursuant to this Agreement to Galaxy Party Rentals or its sub-contractors.
7. USE OF RENTAL ITEMS- The customer shall not allow any person who is not qualified and who has not received and understands safety and operating instructions and who does not utilize all safety equipment required to operate the rental items or the use of rental items. The customer shall not allow any person to use or operate any rental items when it is in need of repair or when presented with an unsafe condition or situation. The customer agrees to visually inspect rental items daily and to immediately discontinue use and notify Galaxy Party Rentals when rental items are found to need repair and/or maintenance. The customer fully acknowledges that Galaxy Party Rentals has no responsibility to inspect the rental items during his/her possession.
8. RENTAL RETURNS- The customer hereby agrees to return the rental items to Galaxy Party Rentals clean and in as good condition as when received, by the agreed return date. The customer shall be responsible for any and all costs of rental items returned damaged and/or lost rental items. If rental items are not returned by the agreed return date, the customer is subject to a 35% late fee charge per overdue day based on the "TOTAL" indicated in the rental agreement.
9. WARRANTIES- Galaxy Party Rentals makes no warranty of merchantability or fitness for any particular use or purpose, either express or implied. The is no warranty or representation that the rental items are fit for the customer's particular intended use, or that it is free of any defects. Galaxy Party Rentals shall not be responsible to customer or any third party of any loss, damage or injury resulting from, or in any way attributable to the operation of, use of, or any failure of the rental items. Galaxy Party Rentals shall not be responsible for any defect or failure unknown to Galaxy Party Rentals.
10. LOCATION OF RENTAL ITEMS- The customer agrees not to sublet, loan or assign the rental items. The customer shall not move the rental items from the address at which the customer represented it was to be used. The customer authorizes Galaxy Party Rentals to enter the event location to deliver and pick-up items. If for any reason it becomes necessary for Galaxy Party Rentals to retake the rental items, the customer authorizes Galaxy Party Rentals to retake the rental items without further notice or further legal process and agrees that Galaxy Party Rentals shall not be liable for any claims for damage or trespass arising out of the removal of rental items.
11. DELIVERY AND PICK-UP- Deliveries are made 1 day prior to the event date unless there is a different agreement with the customer. Delivery fees are based on the distance of the event's venue from Galaxy Party Rentals' facility and the number of trucks used to transport rental items. Delivery is made to the closest point a truck can park. Extra charges will result in deliveries to upstairs, elevator use, far traveling distance from parked truck or any point where extra time is involved. Galaxy Party Rentals does not move or relocate the customer's furniture. If this service is required, the customer must notify Galaxy Party Rentals a few days prior to delivery date.
12. SITE PREPERATION- The customer agrees to have the site upon which the rental items are to be placed/installed, free and clear of all obstacles, natural or manmade, prior to the arrival of Galaxy Party Rentals' work crew. All non-rented items and decorations shall be cleared and taken from sight. If the customer fails to do so, then the customer shall be responsible of paying all costs involved for any delay, additional rental, and all costs including collection and legal expenses.
13. BREAKING GROUND- Before any digging, it is the customer's sole responsibility to follow the requirements of the regional notification center law pursuant to Article 2 (commencing with Section 4216) of Chapter 3.1 of Division 5 of Title 1 of the Government Code. By signing this rental agreement, the customer accepts all liabilities and responsibilities contained in the regional notification center law. The customer agrees to have all Underground Facilities, in the vicinity of the equipment installation, clearly marked prior to the arrival of Galaxy Party Rentals' work crew. The customer is responsible for identifying and notifying to Galaxy Party Rentals of all underground facilities before digging begins. The customer is responsible for any damages due to digging, disturbing soil or earth, staking, post hole digging, auguring, etc. Galaxy Party Rentals is not responsible for any damages to above and below ground obstacles.
14. LINEN- All rental linens will be inspected prior to pick up and upon returning to the Galaxy Party Rentals facility. Do not roll up or place wet linens in a bag for can cause mildew. If there are any obvious damages such mildew, burns, tears, or excessive stains, the customer will be charged the cost of the damaged linens as though it were a sale. All linens are to be returned dry and free from any waste.
15. WEATHER RISKS- The customer assumes all weather related risks involved upon renting and receiving rental items. Galaxy Party Rentals will endeavor to minimize said risk, however, should the rental items/tent become unusable due to extreme weather conditions beyond Galaxy Party Rentals' control, the customer shall remain liable in full payment of all charges.
16. TENTS- a. MATERIAL: All tents are subject to stretching and retracting up to 5% of listed sizes and although all tents have been cured with a waterproofing compound, no tents are guaranteed to be absolutely waterproof and are to be considered temporary shade structures. B. INSTALLATION- All tents must be installed by trained crew members of Galaxy Party Rentals. The customer agrees that he/she or any other third party persons shall not intent to move, remove, reposition or untie the tent under any circumstances. If a tent needs to be moved, repositioned or removed entirely, the customer must notify Galaxy Party Rentals, and a work crew will be sent. C. COOKING UNDER TENTS- The customer assumes full responsibility and costs incurred for damage and/or cleaning expenses to tent tops due to cooking processes under or near tents.
17. CANCELLATIONS- The customer will be charged a 35% cancellation fee if their reservation is cancelled at least 48 hours before the delivery date. All reservations cancelled within 48 hours of the delivery date will result in a 50% restocking fee charge.
18. The customer authorizes and instructs Galaxy Party Rentals to complete the customer's "blank/open check" and to fill-in the amount of all charges.
19. The customer authorizes Galaxy Party Rentals to submit customer's charges to customer's credit card account.
20. WAIVER OF JURY TRAIL. THE PARTIES HEREBY WAIVE THEIR RESPECTIVE RIGHTS TO TRAIL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF THIS AGREEMENT.
21. The customer is fully aware and acknowledges that the terms and conditions of this rental agreement shall apply to all subsequent rentals by the customer. The customer further agrees that the Terms and Conditions of this agreement shall govern all future deliveries should the customer fail or is unable to sign the rental agreement at the time of delivery.
